Welcome to the " Powerful BMS APP Service Agreement" ( hereinafter referred to as "this agreement" ) . The terms and conditions set forth in this agreement apply to various products and services that you (hereinafter referred to as "users") use of the APP .

1. Confirmation of service agreement

1.1 Shenzhen Legend Optoelectronics Co., Ltd. and related affiliated companies (hereinafter collectively referred to as "Leale") agree to provide information about Powerful BMS in accordance with the provisions of this agreement and the operating rules issued from time to time.APP and web-based data services.

1.2 The users of Legendary Powerful BMS products/services (hereinafter referred to as "users") should recognize and agree to all the terms of this agreement on the basis of understanding the entire content of this agreement and on the basis of independent thinking, and follow the prompts on the page to complete all registration procedures , the user's registration, login, use and other behaviors will be deemed to fully accept this agreement and the rules and norms announced by Legendary Company.

1.3 Legendary has the right to Legendary Powerful BMSAPP and Web manage the rights to supervise, prompt, inspect, and correct all activities on the website.

2. Service content

2.1 The specific content of Legendary Services is provided by Legendary Company according to the actual situation, including but not limited to authorized users to upload, search and push relevant information to related users through their accounts, and authorized users to collect and share them, etc. Legendale The right to upgrade or make other adjustments to the service or product form it provides will notify the user by updating the content of the APP / website, and will not notify the user separately.

2.2 The Powerful BMS service provided by Legendary may include advertisements, and users agree to display advertisements provided by Legendary and third-party suppliers and partners during use.

2.3 Legendary Company only provides technical services related to Legendary Powerful BMS services, and other equipment related to related network services (such as personal computers, mobile phones, and other devices related to Internet or mobile networks) and All necessary expenses (such as telephone charges and Internet access charges for accessing the Internet, mobile phone charges for using the mobile network) shall be borne by the user.

3. Service change, interruption or termination

3.1 In view of the particularity of network services (including but not limited to force majeure, network stability, system stability, technical failure, user location, user shutdown, user mobile phone virus or malicious network attack behavior and any other technology, Internet, communication line, content infringement, etc.), the user agrees that Legendary has the right to interrupt or terminate part or all of the services at any time, and Legendary will notify the user in a timely and reasonable manner as much as possible, and try to repair it as soon as possible. However, Legendale does not assume any responsibility for the failure of users to send and receive and read information, or to receive and send wrong information, and users must bear the above risks.

3.2 The user understands that Legendary Company needs to regularly or irregularly overhaul and maintain the platform or related equipment that provides Legendary Powerful BMS services. If the service is interrupted within a reasonable period due to such circumstances, Legendary Company will try its best to Prior notice, but without any liability for this.

3.3 If the personal information provided by the user is untrue, or the user violates the laws, regulations, national policies or the use rules stipulated in this agreement, Legendary Company has the right to interrupt or terminate the provision of services under this agreement to the user at any time without imposing any penalty on the user or any third party. assume no responsibility.

4. Rules of use

4.1 When applying for registration services, users must provide accurate main information (including name, gender, date of birth, telephone, email, etc. when the user is an individual; including name, registered address, registration number, etc. when the user is an organization), If there is any change in the main information, it must be updated in time. Any losses incurred by both parties to the agreement or a third party due to the authenticity of the information provided by the user shall be borne by the user.

4.2 After successful registration, the user will obtain an account and a password set by the user. The user account and password shall be kept by the user; the user shall bear relevant legal responsibilities for all actions of the user account.

Users must abide by the following principles when using the service :

(1) Comply with relevant Chinese laws and regulations;

(2) Legendary Powerful BMS services shall not be used for any illegal purpose;

(3) Comply with all network agreements, regulations and procedures related to network services;

(4) Do not use the Legendary service system to conduct any behavior that may adversely affect the normal operation of the Internet;

(5) Do not use the Legendary network service system to conduct any detrimental behavior to Legendary.

4.3 Users are not allowed to use Legendary services to create, upload, send, and disseminate sensitive information and information that violates the national legal system, including but not limited to the following information:

(1) Objecting to the basic principles established by the Constitution;

(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

(3) Damage to national honor and interests;

(4) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

(5) Undermining the state's religious policies, promoting cults and feudal superstitions;

(6) Spreading rumors, disrupting social order, and undermining social stability;

(7) Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crimes;

(8) Insulting or slandering others, infringing upon the legitimate rights and interests of others;

(9) Contains other content prohibited by laws and administrative regulations.

4.4 The user agrees not to use the account or password of other users under any circumstances. When you suspect that others are using your account or password, you agree to notify Legendary immediately.

4.5 Users have the right to change and delete personal data, registration information and transmission content in the service, but deleting relevant information will also delete any text and pictures you have stored in the system. The user bears the risk.

4.6 If the user violates any terms of this agreement, Legendary has the right to terminate the service provided to the breaching user account in accordance with this agreement.

4.7 If the user does not log in to the account for a long time after registering the account, Legendary has the right to reclaim the account to avoid waste of resources, and the user shall bear all the problems caused by it.

5. Intellectual property rights

5.1 Any text, pictures, logos, audio, and video materials included in the services provided by Legendary are protected by copyright, trademark, patent, and other property rights laws.

5.2 Without the consent of relevant obligees and Legendary, the above-mentioned materials shall not be displayed on any other third-party platforms or used for any other commercial purposes in any way; users shall not copy, modify, compile the above-mentioned content, or create Derivative Products Related to Content.

6. Privacy Protection

6.1 "Privacy" referred to in this agreement includes the content of user personal information stipulated in Article 4 of the "Regulations on the Protection of Personal Information of Telecommunications and Internet Users" and the content that privacy should include in laws and regulations that will be enacted or amended from time to time in the future .

6.2 The protection of user privacy and personal data is a basic system of Legendary. The company will adopt various systems, security technologies and procedures to protect user privacy and personal data from unauthorized access, use or leakage, and Guarantee that the registration information of a single user and the non-public content stored in the company when the user uses the service will not be disclosed to third parties other than the cooperative unit or used for any illegal purposes, except in the following cases:

(1) Obtain the explicit authorization of the user in advance;

(2) According to the requirements of relevant laws and regulations;

(3) In accordance with the requirements of relevant government authorities;

(4) To safeguard the interests of the public;

(5) It is necessary to protect the legitimate rights and interests of Legendary Company when the user infringes the legitimate rights and interests of Legendary Company under this agreement.

6.3 During the process of registering a Legend APP account or using APP services, users need to provide some necessary information, such as: name, phone number, email address, gender, date of birth, name, registered address, registration number, etc. In order to provide users with account registration services or identify users, users are required to fill in their mobile phone numbers, etc. If the user does not authorize or provides incomplete information, the service cannot be used or restricted during use. Legendary Company promises to take measures to protect the security of users' personal information.

6.4 In order to provide users with a better user experience and improve the service quality of the Legendary APP, the company may collect, use or provide users' non-personal privacy information to third parties. Legendary Company will supervise and manage the use of the user's personal data by the third party, and make every possible effort to protect the security of the user's personal information.

7. Disclaimer

7.1 Users shall abide by national laws, regulations and policy provisions in the process of using the service, and bear any legal responsibility for the information and content produced, uploaded, sent and disseminated by them, which has nothing to do with Legendary.

7.2 If any information and content that Legendary APP displays and pushes to users on its pages is recommended to users by the company after searching, locating, and matching from any third-party website on the Internet by using technical means according to user instructions, it is not unilaterally produced by the company. The information and content displayed and pushed do not represent the opinions of Legendary Company and the company's APP, and Legendary Company is not responsible for the accuracy and correctness of the above information.

7.3 Any text, pictures, logos, audio, and video materials contained in the APP service provided by Legendary Company are for teaching purposes and do not involve any commercial activities of physical items.

7.4 If any information and content displayed or pushed by the Legend APP to users on its page is suspected of infringing the intellectual property rights of any third party, the obligee and relevant interested parties shall issue a rights notice to the company, and the company shall, after verification, comply with relevant laws and regulations. The regulations have the right to take actions including but not limited to disconnecting the link of the infringing content or deleting and stopping the transmission of the infringing content, but Legendale does not bear legal responsibility for the infringing content.

7.5 The user agrees to indemnify Legendary from damages caused by any claim, demand or loss claimed by any third party, including reasonable attorney fees, caused or incurred by the user’s violation of the provisions of this agreement.

8. Other Terms

8.1 Legendary has the right to modify any terms of this agreement at any time. Once the content of this agreement changes, the company will announce the revised agreement on the APP platform or announce the revised content to users through other appropriate means. If the user disagrees with the above amendments, he has the right to choose to stop using the service, but if the user continues to use it, it is deemed to accept Legendary's amendments to the relevant terms of this agreement.

8.2 No matter what reason any clause in this Agreement is partially or completely invalid or non-executable, the remaining clauses of this Agreement shall still be valid and binding.

8.3 The conclusion, execution and interpretation of this agreement and the settlement of disputes shall be governed by the laws of the People's Republic of China and subject to the jurisdiction of the courts of the People's Republic of China. If any disputes or disputes arise between the two parties regarding the content or implementation of this agreement, they should first be resolved through friendly negotiation. If the negotiation fails, either party may file a lawsuit with the competent people's court where Legendary is located.

8.4 The copyright of this agreement belongs to Legendary Company, and the right of final interpretation and modification of the contents of this agreement belongs to Legendary Company.
